I have the honour to transmit for your

consideration the enclosed copy of correspondence on the

subject of the delay in the progress of litigation in the

Supreme Court and of proposals to prevent such delay in the

future.

Attention has been drawn to the subject

by the abnormal length of the hearing in the case referred to in paragraph 6 of the Chief Justice's letter of the 13th. of June. The hearing of this case, upon which I shall address you separately, occupied 121 days and has just been

concluded.

In amplification of the reasons given by

the Bar in en dusure No. 5 against any increase in the jurisdiction of the Summary Court, I would remark that it is

well known that a large amount of litigation and particularly Summary Court litigation is manufactured by a set of entire- -ly unscrupulous persons whom certain lawyers employ as clerks or touts for business. By the wise provision which limits the amount in Summary cases to £1,000 the activities of these people are curtailed, as their prospective victims hesitate before the heavy expense of Original Jurisdiction.
